im leasing my house my lease is up in feb /09 , my landlord is getting a divorce, can he legally make me move , before my lease is up?

  1. HE SURE CAN! He has a right to live in his own house. However, he has to help pay your moving expenses and make sure you have a place to go.
  2. No...that's what leases are for...to protect both tenant and landlord. Unless you default on rent or behave unreasonably toward the property, you are safe. Get some legal advice.
  3. Yes, he can in order to reside in it himself. A homeowner can not be forced into homelessness. He can not break the lease to move another person in, only himself.

The divorce is not a valid reason to terminate a valid contract, both parties are bound by the terms of the lease agreement until it expires, it is the landlords fault to have given you such a long term lease but at the same time the landlord wanted stability with a long term tenant and they have that, the divorce is immaterial to the lease agreement if the landlord is desperate maybe they can buy you out? but no landlord tenant court is going to terminate the lease just because the landlord is getting a divorce
  5. Depends on ur state laws. u have legal documents to occupy the house. the next owner has to honor it as does the present owner. time to check with local lawyers/housing authoritys. suggest u get a budget and start saving money cause u may have some expenses u hadn't planned on.
  6. Generally no. The lease should supercede. But talk to a real estate attorney. Contact your state Bar Association, see if they have a reduced price service where a lawyer will talk with you for a nominal fee. We have that in Georgia.
