Real Estate?

My ex has several rental houses where she is transferring the deed to me per a seperation agreement. She currently has them listed for sale with several real estate agents and has signed seller agrements with the agents. If she signs the deed over to me, do I have to honor the contracts with the real estate agents that she signed? I did not sign them. I would rather sell them "By Owner".

  1. I believe the contracts will end. They are signed by her but she no longer has any say about the homes once ownership is transferred to you. The contract are with her not the home. As far as selling them on your own that is another topic, good luck and do your research.
  2. Have her contact the agents and try and cancel her listings.
  3. The owner of the property is the one who must sign a listing agreement, which states the terms and fees associated with listing the house for sale. If your ex signed a sellers agreement only she can be held responsible for the length of time stated on the agreement. NOTE: It would be nice of the owner to notify the agent who has listed the property since they have invested time and expense into marketing and selling that property. Good luck selling in this current real estate market, even agents who are professionally trained are missing the mark for getting their listed properties sold. Why sell at all! you must be getting them at a reduced market price and the real estate market will rebound depending on the property and location, it could be a sweet deal to keep them awhile.
  4. In Most states it's one to buy, and two to sell if married. So if she listed the houses for sale and you are still married and you didn't sign the listing agreement, she could have a problem. My suggestion would be for her to cancel the listings, then have an attorney draw up the quit claim deeds and you both sign.
