Real Estate...?

We just bought a home in August. We are completely unhappy with everything. The neighbors, up all night making noise, we called the cops a few times, plus we have a child on the way i don't want to be worrying about the noise with an infant. The POA, they are supposed to keep up the "common area" such as playgrounds, walking trails, ect. and keep up the exterior of the home and front yard. Well the sod they put down died within a week, they havent ever cut the grass anywhere and there is trash EVERYWHERE. And things keep breaking in our house and it's new construction. We really want to move but didn't know if it was possible to sell our house so soon since we just moved in. We've already found another house which is a lot closer to our parents. I was just wondering if there were any real estate agent or lawyers that could give us some advice or anyone that might(heaven forbid) been through what we have.

  1. 1st thing to do is contact the agent who sold you the house and your lender. Are there any finance charges you would incur by paying off your Mortgage early? If there aren't or if they are reasonable enough that you will eat them just to get outta there then put your house on the market. When it sells buy the other house. If your having a hard time selling or want to move ASAP (like before the baby is born) Then see if you could come up with enough and have a good enough credit score to buy the other house and rent the one your living in now. Just make sure whoever you rent it to is blind and deaf; ) Well good luck for sure!!!!

  3. Of course it’s possible to sell your house; there’s just a great chance it will be at a financial loss. Anytime someone moves within the first couple of years of ownership, it’s a sign of trouble: they don’t like the house, can’t afford it, or have to move for work. The buyer uses your desperation as a bargaining tool to get a low price. For damage issues, have you contacted the builder for assistance? And who is in charge of the HOA (at least that’s what I assume you meant by POA?)? In my subdivision, I know who all of the officers are and where they live so it’s not hard to reach someone if I have an issue with something.
  4. Check with the state's realtor association. In NJ NEW HOMES get a 10 warranty. Sounds like you have some recourse to for recovery.
